The Commission for a new Constitution – A Constitution to strengthen democracy

Debates on constitutional themes have been marked lately by an unprecedented degree of populism, which endangers the democratic stability of our country. The Government’s intempestive initiative to modify the Constitution, the very second day after the Parliament had decided to create a Commission for this purpose, leads one to believe that Romania is running the risk of deviating towards an authoritative regime. The actions of the Government represent a new diversion, meant to distract the public’s attention from the real problems facing the Romanian society. By constantly undermining the authority of various institutions, the current power endangers the balance of power between these.

The Horia Rusu Foundation maintains that adopting a new Constitution, attuned to our traditions and to the current environment, must not become a pretext for political and media blackmail. On the contrary, it must involve all of society’s representative structures – political parties, specialists in Law and Political Sciences, representatives of the civil society. A Constitution must be carefully written, without rush, to be founded on timeless principles and must be a beacon of stability for the entire society. It is necessary to devise a coherent Constitution, which would represent a guarantee for the permanence of the democratic regime and prevent the risk of the serious problems that have become apparent over the past few years. The new Constitution must transform Romania into a state whose institutions are organised around the fundamental mission of safeguarding the freedom and rights of the individual.

With these convictions, the Horia Rusu Foundation announces the creation, under its leadership, of a Commission made up of reputed specialists in Law and Political Sciences, which would lay the foundation of a new Constitution.

The members of the Commission for a New Constitution are:

  • Prof. Daniel Barbu (PhD) – University of Bucharest, School of Political Sciences, specialist in Political Sciences;
  • Prof. Gheorghe Piperea (PhD) – University of Bucharest, School of Law, specialist in private law;
  • Prof. Corneliu Liviu Popescu (PhD) – University of Bucharest, School of Law, specialist in international defence of human rights and European legislation in the field of Human Rights;
  • Prof. Simina Tănăsescu (PhD) – University of Bucharest, School of Law, specialist in Constitutional Legislation.

The commission will submit for public debate the principles of a Constitution capable of consolidating democracy and the lawful state in Romania. The themes of the debates, organised each month, will focus on the quality of democracy, the the individual rights and freedoms, Parliament, the Executive, local and regional autonomy, independence of Justice and the role played by the Constitutional Court.
